  1. My understanding of water access laws is that this is a Federal test, not one that states nor municipalities can legislate to suit their own agendas. Furthermore, Federal law regarding navigability says, “If a river is navigable in fact, it is navigable by law.”

    Federal law holds that all moving, navigable waterways are owned by and held in trust for, the public. The last time I checked, Federal law trumps local law.
